Terms of Use

These Terms of Use ("Terms") govern your use of One Big Fab Family (the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

1. Eligibility & accounts

You must be at least 16 years old (or the age of digital consent in your country) to create an account. You are responsible for keeping your login credentials secure and for all activity under your account. Please give accurate registration information and keep it up to date.

2. Acceptable use

• Do not upload unlawful, defamatory, or infringing content.
• Do not add personal data about living people without a lawful basis or their awareness where required.
• Do not attempt to breach security, scrape, overload, or reverse-engineer the Service.
• Do not use the Service to harass others or to send spam.
• Only upload audio, documents, photos or video links (e.g. YouTube) that you have the right to use and share, and that do not infringe anyone’s rights.
• When commenting on a public profile, be respectful and truthful; do not post spam, abuse, or others’ private information. Comments are moderated and may be removed.

3. Your content

You retain ownership of the family-tree data, photos, and notes you add. You grant us a limited licence to store and process this content solely to operate the Service for you. You are responsible for having the right to upload the content you add, including any photos and information about other people. You are responsible for the audio, documents, images and video links you add. Where a tree is public or shared by access code, visitors may leave comments on the profiles of deceased people; the tree owner moderates and may remove any comment, and we may remove content that breaches these terms or the law.

4. Subscriptions, pricing & payment

• Access to paid features requires a yearly subscription.
• Regional pricing: the price shown is based on your approximate location and is charged in your local currency - currently ₹199/year (India), €9.99/year (EU), or $9.99/year (rest of world). The billing address you provide at checkout determines the final applicable price and currency.
• Taxes: where required (for example EU VAT), applicable taxes are calculated and shown at checkout.
• Payment: payments are processed securely by Stripe. We do not store your card details.
• Automatic renewal: your membership renews automatically each year using your saved payment method, so your family trees stay online without interruption. We email a receipt after every payment and a reminder before each renewal. You can turn off automatic renewal at any time before a renewal date.

5. Right of withdrawal & refunds

If you are an EU/UK consumer, you normally have a 14-day right of withdrawal for digital services. Because the Service gives immediate access to digital content, by subscribing you ask us to begin at once and acknowledge that your withdrawal right ends once access has been provided, except where the law provides otherwise. We do not offer pro-rated refunds for the unused part of a term after you cancel. If you were charged for an automatic renewal you did not intend, contact us within 14 days of that charge and we will refund it in full. 6. Cancellation, deletion & inactive accounts

You can turn off automatic renewal at any time from your billing settings; this stops future charges while your membership stays active until the end of the period you have already paid for. You can also permanently delete your account and all associated data from your Account & privacy page. For your protection, account deletion has a short cooling-off period during which you can cancel it; after that it is permanent and removes your trees and everyone in them. If a membership lapses, your data is kept safe and becomes view-only for a limited period (currently up to nine months) before removal, and we email advance warnings first - you can renew or export your data at any time. If you do not sign in for an extended period (currently six months), we may notify the trusted contacts you have named, and a successor you have chosen can ask to take over your family trees through a secure, single-use link, so your family history is never lost. Signing in at any time stops this process.

7. Intellectual property

The Service software, design, and branding are owned by One Big Fab Family and protected by law. These Terms do not grant you any right in our intellectual property beyond using the Service as intended.

8. Disclaimers & liability

The Service is provided "as is". To the extent permitted by law, we disclaim implied warranties and are not liable for indirect or consequential loss. Nothing in these Terms limits liability that cannot be limited by law, including your statutory consumer rights. Please keep your own backups of important data.

9. Suspension & termination

We may suspend or close accounts that breach these Terms or the law. If we close your account other than for breach, we will, where reasonable, give you an opportunity to export your data first.

10. Changes & governing law

We may update these Terms; material changes will be posted here with a new date. These Terms are governed by the applicable laws of your country of residence where mandatory consumer-protection rules apply, and otherwise by the laws of the operator's home jurisdiction.
